Personal Injury Claims for Workplace Accidents

Accidents that happen in the work place are often caused by the negligence of someone else and the law states that you have the right to bring a claim for compensation against the person or organisation responsible.

You can make a claim for an injury caused by an accident at work:

  • If the accident happened during the past three years
  • If the accident was not your fault

The law is in place to protect clients who have suffered injuries and associated financial losses through no fault of their own and often lives are turned upside down overnight resulting in, stress, emotional and financial pressure on both the injured party and their family.

We specialise in personal injury law, enabling us to offer a high level of service and expertise to our clients as we handle each case individually and with care.

What Counts As An Accident at Work?

The most common work accidents are slips or trips within the workplace or accidents involving work machinery. This can include forklifts, saws or farm machinery. Injuries suffered at work may also involve inhalation of toxins, and chemical or electrical burns.

Workplace accidents can be caused by inadequate training, particularly manual handling training and repetitive strain injury as a result of excessive use of tools. Failure to adequately maintain equipment used by employees can also contribute to injuries at work.

Common workplace accident injuries

  • Orthopaedic Injuries (neck, back, shoulder, knee, ankle, wrist, leg etc)
  • Brain and Head Injuries
  • Injuries affecting the senses (eyes, hearing, taste and smell)
  • Injuries to internal organs
  • Scarring and Facial Injuries
  • Psychological Injuries (travel anxiety, Post Traumatic Stress Disorder, etc

Duty of Care

Every employer has a duty to take reasonable care of the health and safety of its employees. As far as reasonably practicable, they must ensure employees are not exposed to unnecessary risk.

The Health and Safety at Work Act 1974 requires employers to ensure that the work environment, facilities and equipment they provide can be used safely and without risk of injury.

It is also worth noting that it is illegal for your employer to unfairly dismiss you or discriminate against you for bringing a claim following an accident at work. Should this happen, we can recommend solicitors who specialise in employment law matters.

Claim Process for Accidents at Work

Making a claim

The first step in the process is for us to prepare a draft Claim Notification Form setting out the allegations of negligence and providing details of the nature and extent of the injuries you have suffered.

You should:

  • request to have details of your accident recorded in the accident book at work
  • collect evidence such as CCTV footage, photos, witness statements, etc.

Under the Personal Injury Protocol, the insurers will have 30 working days in which to respond to the claim with their views on liability. If your employer denies responsibility for your accident, we will request that they disclose all documentation in support of their denial, for consideration.

Depending on the severity of the accident or the amount of time you are off work, your employer may need to report the details to Health and Safety Executive who may investigate the accident. However, not all accidents are reported by employers and it is therefore a good idea to either report the matter yourself or instruct your solicitors to report the matter on your behalf.

How Much Compensation Could I Receive?

The amount of compensation you can expect to recover following an accident at work will depend upon the nature and extent of your injuries, the duration of symptoms, and the effect upon your quality of life.
