Will a 'No Win, No Fee' Claim Cost Me Anything?

You should never have to pay any money from your own pocket throughout the ‘No Win, No Fee’ process, except in exceptional circumstances.

Before you sign a contract, we’ll explain every part of the claims process to you. This will include which fees will come out of your compensation if you win, and what you could be liable for if you lose.

What Happens If You Win

If you win your case then your solicitor will collect their fees from your compensation – not the opposing party. Finances that can be claimed through your compensation are:

  •  The Success Fee: This covers your solicitor’s time and expenses. It’s capped at 25% of your general damages, but at RG Jones we only charge 20%. Any compensation you receive for financial losses (lost earnings, medical expenses etc.) is protected from this fee.
  • After the Event (ATE) insurance premium: This insurance policy is taken out to protect you if your claim fails. It covers the other side’s legal fees and disbursements. If you win your claim, you pay for the premium out of your compensation.
  • Disbursements: Out-of-pocket costs for submitting a claim. These can include medical reports, court fees, or expert witness fees. In most cases disbursements are recovered from the other side, but you may be liable for some expenses.

What Happens If You Lose

If you lose your case then you will pay no solicitor’s fees. The Conditional Fee Agreement waives these fees and the After the Event insurance policy covers the other side’s legal costs. These protections apply whether your claim was settled in or out of court.

No Win No Fee Exceptions

The one exception is if you have exaggerated your injuries or the situation in your favour.

If a court finds that you were fundamentally dishonest, you could be liable for the other side’s legal costs. Being honest with your solicitor about the situation and any other relevant factors can help to protect your claim.
